Terms of Service

Welcome to Coconut. These Terms of Service ("Terms") are a binding agreement between you and Coconut, LLC ("Coconut," "we," "us," or "our") governing your access to and use of our websites, apps, wireless services, marketplace, streaming, communities, Coconut for Business, and any other products or services we offer (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility & Accounts

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Services, and at least 18 to make purchases or enter into contracts. You are responsible for the security of your account and for all activity under it.

2. License to Use the Services

Subject to these Terms, Coconut grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use (or for your business as expressly permitted via Coconut for Business).

3. User-Generated Content

"User Content" means any content you post, upload, transmit, stream, or otherwise make available through the Services, including posts, comments, photos, videos, reels, stories, live broadcasts, messages, reviews, listings, and community contributions.

3.1 Your responsibility

You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that (a) you own or have the necessary rights to your User Content, (b) it does not violate any third party's rights, and (c) it complies with these Terms and applicable law.

3.2 License to Coconut

By submitting User Content, you grant Coconut a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, create derivative works of, communicate, publish, publicly perform, publicly display, and distribute your User Content in connection with operating, promoting, and improving the Services. This license ends when you delete your User Content, except to the extent it has been shared with others who have not deleted it, or where retention is required by law.

3.3 Prohibited content and conduct

You agree not to post or use the Services to:

  • Harass, threaten, intimidate, defame, dox, or impersonate anyone, including Coconut artists, employees, partners, members, creators, or other users.
  • Post sexually explicit, violent, hateful, discriminatory, or unlawful content.
  • Infringe intellectual property, publicity, or privacy rights.
  • Distribute spam, malware, scams, or deceptive content.
  • Scrape, crawl, or harvest data without our written permission.
  • Attempt to access another user's account or any non-public area of the Services.

4. Anti-Stalking, Anti-Harassment & Personal Safety

Coconut is committed to protecting the safety, dignity, and privacy of every member of our community — including artists, creators, public figures, employees, partners, and everyday users. By using the Services, you agree that you will not, directly or indirectly:

  • Stalk, follow, surveil, monitor, or track any individual without their express consent, whether online or offline, including through the Services, third-party platforms, location data, IP addresses, or any other means.
  • Harass, threaten, or intimidate any individual, or encourage, facilitate, or coordinate others to do so.
  • Approach, contact, or attempt to contact Coconut artists, performers, executives, employees, contractors, partners, their family members, or their household, security, or staff at their homes, hotels, dressing rooms, vehicles, places of worship, schools, medical facilities, or any other private location.
  • Disclose, post, or share private or identifying information ("doxing") about any person, including home addresses, phone numbers, private email addresses, travel plans, schedules, license plates, family members, minor children, or biometric data.
  • Use the Services to plan, organize, or coordinate any in-person approach, ambush, "swatting," paparazzi-style pursuit, unwanted gift delivery, or other physical contact with any person without their consent.
  • Create fan accounts, parody accounts, or impersonation accounts that misrepresent the identity of, or speak on behalf of, any Coconut artist, employee, or partner.
  • Photograph, film, record, or live-stream any individual in a private setting, or in a public setting in a manner that would constitute harassment, stalking, or invasion of privacy under applicable law.
  • Use bots, automation, fake accounts, or coordinated inauthentic behavior to amplify harassment or to evade enforcement actions taken against you.
  • Bypass, ignore, or attempt to circumvent any block, restraining order, no-contact order, restraining order under applicable law, or written cease-and-desist communication issued by Coconut or any individual.

Any violation of this Section 4 is a material breach of these Terms. Coconut may, in its sole discretion and without notice: remove content; suspend or permanently terminate your account and any affiliated accounts; ban you from in-person events, properties, retail stores, and Coconut for Business engagements; revoke purchases, tickets, or memberships without refund; cooperate with law enforcement; share information (including identifying information) with affected individuals, their representatives, and authorities; and pursue civil and criminal remedies, including injunctive relief and recovery of attorneys' fees.

If you believe you are being stalked, harassed, or threatened — by anyone, on or off our Services — please contact local emergency services first, then report it to safety@coc0nut.com.

5. Communities & Live Features

Communities, comments, messages, reels, stories, and live broadcasts are subject to community guidelines incorporated by reference. Moderators and Coconut staff may remove content or restrict accounts that violate these Terms or community guidelines.

6. Purchases, Subscriptions & Wireless

Purchases through the Shop, Marketplace, Wireless plans, Restaurant orders, Travel bookings, and Coconut for Business engagements are subject to additional terms presented at checkout. All sales are final unless otherwise stated. Wireless service is subject to coverage, network availability, and acceptable use policies.

7. Intellectual Property

The Services, including all software, designs, logos, trademarks, and content provided by Coconut, are owned by Coconut or its licensors and are protected by intellectual property laws. Except for your User Content and rights expressly granted, no rights are transferred to you.

8. DMCA & Copyright

If you believe content on the Services infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to dmca@coc0nut.com. We may remove infringing content and terminate repeat infringers.

9. Termination

You may stop using the Services at any time. Coconut may suspend or terminate your access to all or part of the Services at any time, with or without notice, for any reason, including violations of these Terms.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COCONUT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO COCONUT IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

12. Indemnification

You agree to indemnify and hold harmless Coconut and its affiliates, officers, employees, and partners from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your User Content, your use of the Services, or your violation of these Terms or applicable law.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-laws principles. Any dispute will be resolved by binding arbitration on an individual basis (no class actions), except that either party may seek injunctive relief in court for violations of Sections 3, 4, or 7.

14. Changes

We may update these Terms. Material changes will be posted here with a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance.
